1. Our Service
Nutrigenomix is a University of Toronto spinoff biotechnology company that provides genetic test kits, genotyping and customized reports for personalized nutrition to health and wellness clinics with healthcare professionals (the “Nutrigenomix Service”).
Nutrigenomix provides its test kits only through healthcare professionals working in private practice or as part of a health and wellness clinic (the “Healthcare professional” or “Clinic”).
You should only receive this service through a consultation with a healthcare professional, and by agreeing to provide the Nutrigenomix service, your healthcare professional, or the Clinic on behalf of its healthcare professionals, has warranted to us that they are a healthcare professional, appropriately accredited and in good standing.
Nutrigenomix makes no warrants about its product whatsoever and does not provide any support if you have used the Nutrigenomix test kit in any way other than through a healthcare professional.
By using the Nutrigenomix service, you also represent and warrant that any saliva samples you submit to us as part of the Service are your own, that you have followed the saliva collection instructions provided by your healthcare professional and that you will not use our website or the Service for any purpose that is unlawful, unethical or in violation of these Terms.
All sales are final. All Nutrigenomix tests and services are non-refundable. There may be a charge for rerouting or resending the package if the address is not entered correctly on the order form. There may be a charge for the sample recollection if the sample is collected improperly.
2. Nutrigenomix is Not Medical Advice
The Nutrigenomix Service, including test results, your personalized nutrition report (Report) and any other information provided in our materials or on this website, is for information purposes only, and is not a substitute for medical advice.
This report has been prepared by Nutrigenomix Inc. ("Nutrigenomix"). By accessing, using, reviewing or relying upon this report, you acknowledge and agree to the following terms, which apply to you whether you are a healthcare professional, clinic, client/patient or any other person who receives, accesses, uses or relies upon this report.
This report is provided strictly for general informational and educational purposes only and is not intended to be used as medical advice or to treat, prevent, diagnose or cure any medical condition or disease. Nothing in this report constitutes medical advice, diagnosis, treatment recommendations, dietary prescriptions or a professional opinion of any kind. This report is not a substitute for the independent clinical judgment, expertise and training of a qualified healthcare professional with knowledge of the individual client/patient’s circumstances, medical history, allergies, contraindications, concurrent medications or treatments, and overall health status. To the maximum extent permitted by applicable law: (a) in no event shall Nutrigenomix, its directors, officers, employees, agents, consultants, affiliates, licensors, suppliers, partners, successors or assigns (collectively, the "Nutrigenomix Parties") be liable to any person for any indirect, incidental, special, consequential, punitive or exemplary damages arising out of or in connection with this report or any information, suggestions or recommendations contained herein, regardless of the cause of action or theory of liability (whether in contract, tort, negligence, strict liability, breach of statutory duty or otherwise), and regardless of whether Nutrigenomix has been advised of the possibility of such damages; and (b) the total aggregate liability of the Nutrigenomix Parties arising out of or in connection with this report or any information, suggestions or recommendations contained herein, including any use of or reliance upon this report, regardless of the cause of action or theory of liability, shall not exceed the price paid for the specific test kit and related report giving rise to the applicable claim.
By accessing, using, reviewing or relying upon this report, you acknowledge and assume all risks associated with such use or reliance and agree that the Nutrigenomix Parties shall not be liable for any loss, damage, injury, claim or liability arising from or in connection with your use of or reliance upon this report or any information, suggestions or recommendations contained herein.

3. Privacy and Security of Information
Nutrigenomix takes your privacy and the security of your information very seriously. Only your healthcare professional/clinic will be able to access your genetic test results. Your Nutrigenomix test kit is marked with a unique barcode, which is what our laboratory will use to analyze your sample. Only your healthcare professional will be able to link your kit’s barcode to your personal information. Nutrigenomix uses the Secure Socket Layer (SSL) protocol to encrypt information that is transmitted over the Internet. This technology uses 256-bit encryption, which ensures that confidential information cannot be viewed, intercepted or altered.
Nutrigenomix will store your barcoded and anonymized DNA sample so that you will have the opportunity to be tested for additional genetic variants as new discoveries are made and the science develops. We do this so that new tests can be performed at your request without the need to collect another saliva sample and its associated costs. However, you may have your sample destroyed by sending a written request to your healthcare professional, who will inform Nutrigenomix.
Your personal genetic information will never be disclosed to a third party without your explicit written consent to do so, unless required by law. Nutrigenomix may update our privacy and security policies and practices from time to time. We will continue to use commercially reasonable safeguards against unauthorized disclosure of or access to your genetic data or other personally identifiable information about you.
However, by agreeing to use the Nutrigenomix Service, you acknowledge that security safeguards, by their nature, are capable of being circumvented and that Nutrigenomix cannot guarantee that personally identifiable information about you will not be accessed by unauthorized people who are able to overcome such safeguards, including actions aimed at accessing information over the Internet.
You should be careful about sharing the results of your Report and any related information. Genetic information that you share with others may be used against your interests. You may wish to seek legal advice to understand the extent of legal protection of your genetic information before you share it with anybody. Genetic information that you choose to share with your physician or other health care provider may become part of your medical record and may become accessible to other health care providers or insurance. If you are asked by an insurance company whether you have learned about your genetic information and you do not disclose this to them, this may be considered to be fraud.
Nutrigenomix cannot be responsible for any personally identifiable genetic information about you that you release on your own, or that you request or authorize us to release.
The Nutrigenomix website uses cookies and similar technologies to operate our site, remember preferences, analyze traffic and usage, and improve your experience with our Services. You may disable cookies in your browser settings, but some site features may not work.

The Nutrigenomix name and logo are trademarks of Nutrigenomix Inc. Nutrigenomix owns all of the content in its materials, including the content of this website. All content, trademarks, service marks, trade names, and products on this website and in our materials are protected in Canada, the United States and internationally. No use of any of these may be made without the prior, written authorization of Nutrigenomix Inc.
Nutrigenomix grants you a non-exclusive, non-transferable, revocable, limited license to receive our Services that you purchase from a healthcare professional, and to view and print one or more copies of your Report and a single copy of any other content obtained by you from our website, for your non-commercial personal use only, provided that you do not remove or obscure any copyright notice, trademark notice, or other proprietary rights notices.
5. Disclaimer of Warranties
Our site, Services, your Report and other content are provided on an "as is" basis, and you use them at your own risk. Nutrigenomix expressly disclaims all warranties of any kind, whether express or implied, including, without limitation, any warranties of merchantability, fitness for a particular purpose, or non-infringement. Nutrigenomix makes no warranties as to the accuracy, quality or reliability of our site, the Services, your Report or other content, or any results that may be obtained from their use, or advice based on their use.
The Nutrigenomix Service, including all test kits, genotyping services, reports (including any suggestions, recommendations or references to third-party products or supplements contained therein), and all related materials, information and content, are provided for information purposes only and are provided without any representations or warranties of any kind, whether express, implied, statutory or otherwise. To the fullest extent permitted by applicable law, Nutrigenomix expressly disclaims all representations and warranties, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, compatibility, or arising from any course of dealing or usage of trade. Without limiting the generality of the foregoing, Nutrigenomix does not represent or warrant that: (a) the Nutrigenomix Service, test kits, reports or any information, suggestions or recommendations contained therein will be accurate, complete, current, reliable, or error-free; (b) the results obtained from the use of, or reliance upon, any Nutrigenomix Service will meet the Healthcare professional's or Clinic's requirements or expectations; or (c) any suggestions, recommendations or references to third-party products or supplements contained in any report will be suitable, effective or appropriate for any particular client/patient or individual.
6. Reports
The Healthcare professional and/or Clinic acknowledge and agree that all reports generated by Nutrigenomix in connection with or as part of any Nutrigenomix Service, including any suggestions, recommendations or references to supplements or other products contained therein, are provided strictly for general informational and educational purposes only and do not constitute medical advice, diagnosis, treatment recommendations, dietary prescriptions or professional opinions of any kind.
The Healthcare professional and/or Clinic acknowledge and agree that: (a) such reports are intended solely to assist healthcare professionals in their independent professional assessment and are not a substitute for the Healthcare professional's or Clinic’s own clinical judgment, expertise, training and knowledge of the client/patient's individual circumstances, medical history, allergies, contraindications, concurrent medications or treatments, and overall health status; (b) the Healthcare professional and/or Clinic bears sole responsibility for determining how to use, interpret, apply and act upon any information, data, suggestions or recommendations contained in such reports, including any decision to recommend or prescribe any supplement or product referenced therein to a client/patient; (c) any reliance by the Healthcare professional, Clinic, client/patient or any other person on the such reports or any information, suggestions or recommendations contained therein is entirely at the Healthcare professional's or Clinic's own risk; (d) the Healthcare professional and/or Clinic is solely responsible for exercising independent professional judgment in reviewing such reports and for making all clinical and dietary decisions regarding their clients/patients; and (e) Nutrigenomix is not responsible for any decision by a Healthcare professional, Clinic, client/patient or any other person to use, rely upon, act upon or disregard any information, suggestion or recommendation contained in any such reports. Without limiting the generality of the foregoing, the Healthcare professional and/or Clinic acknowledge and agree that any references to third-party products or supplements contained in such reports are included for informational purposes only and do not constitute an endorsement, recommendation or guarantee by Nutrigenomix of the safety, efficacy, quality, suitability or appropriateness of any such product or supplement for any particular client/patient or individual. The Healthcare professional and/or Clinic is solely responsible for independently evaluating the suitability and appropriateness of any such product or supplement for their clients/patients, including considering potential interactions, contraindications, allergies and the client/patient's overall health status.
7. Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law: (a) in no event shall Nutrigenomix, its directors, officers, employees, agents, consultants, affiliates, licensors, suppliers, partners, successors or assigns (collectively, the "Nutrigenomix Parties") be liable to the Healthcare professional, Clinic, any client/patient or any other person for any indirect, incidental, special, consequential, punitive or exemplary damages arising out of or in connection with the Nutrigenomix Service, the test kits, the reports, any information, suggestions or recommendations contained therein, or these general terms, regardless of the cause of action or the theory of liability (whether in contract, tort, negligence, strict liability, breach of statutory duty or otherwise), and regardless of whether Nutrigenomix has been advised of the possibility of such damages; and (b) the total aggregate liability of the Nutrigenomix Parties arising out of or in connection with the Nutrigenomix Service, the test kits, the reports, any information, suggestions or recommendations contained therein, or these general terms, regardless of the cause of action or the theory of liability (whether in contract, tort, negligence, strict liability, breach of statutory duty or otherwise), shall not exceed the price paid for the specific Nutrigenomix Service, including, as the case may be, the specific test kit and related report, giving rise to the applicable claim.
Nutrigenomix shall have no liability whatsoever in respect of any third-party products or supplements that may be referenced, suggested or recommended in any report forming part of the Nutrigenomix Service. The Healthcare professional and/or Clinic acknowledge and assume all risks associated with the use of the Nutrigenomix Service, the test kits and the reports, including any reliance on the information, suggestions or recommendations contained therein, and agree that Nutrigenomix shall not be liable for any loss, damage, injury, claim or liability arising from or in connection with such use or reliance.
The Healthcare professional and/or Clinic agree to indemnify, defend and hold harmless the Nutrigenomix Parties from and against any and all claims, actions, proceedings, demands, damages, losses, liabilities, judgments, settlements, costs and expenses (including reasonable legal fees and disbursements) arising out of or in connection with: (a) the Healthcare professional's or Clinic's use of or reliance upon the Nutrigenomix Service, test kits, reports or any information, suggestions or recommendations contained therein, including any claim by or on behalf of a client/patient of the Healthcare professional or Clinic; (b) any decision by the Healthcare professional or Clinic to recommend, prescribe or administer any product, supplement, dietary advice or treatment to a client/patient based in whole or in part on the Nutrigenomix Service, test kits, reports or any information, suggestions or recommendations contained therein; and/or (c) the Healthcare professional's or Clinic's breach of these general terms or violation of any applicable law, regulation, professional rule or standard of care. Nutrigenomix reserves the right to assume the exclusive defence and control of any matter subject to indemnification by the Healthcare professional and/or Clinic, in which event the Healthcare professional and/or Clinic shall cooperate fully with Nutrigenomix in asserting any available defences.
8. These Terms of Service May Change
Nutrigenomix may make changes to its privacy policy and terms of service from time to time. When these changes are made, Nutrigenomix will make a new copy of these available on its website.
You acknowledge and agree that if you use our Services after the date on which the privacy policy and terms of service have changed, Nutrigenomix will treat your use as acceptance of the updated privacy policy and terms of service.
